Man who withdrew an injury claim is arrested

A 40-YEAR-OLD was arrested for conspiracy to defraud an insurance company when he withdrew a personal injury claim in the High Court after video footage taken by a private investigat­or was shown in the court.

Constantin Iosca is expected to appear in Dublin District Court next week on charges related to attempted deception and making a false affidavit.

Romanian national Mr Iosca (40), of Scholars Walk, Lusk, Dublin, was arrested by detectives from the Garda National Economic Crime Bureau (GNECB) in north Dublin yesterday. A senior source said fraud squad detectives have utilised a little-used section of legislatio­n under the Civil Liability and Courts Act 2004 as part of their investigat­ion into Mr Iosca.

“In this case it is an allegation that he made a false affidavit that he could not walk on August 6, 2019,” the source told the Irish Independen­t.

“There is also an allegation of attempted deception in relation to an alleged accident that happened on June 1, 2016,

which was reported by Mr Iosca to gardaí two days later,” the source added.

Mr Iosca (40) sued the Motor Insurers’ Bureau of Ireland (MIBI) when he claimed his bicycle was struck in 2016 by a car which could not be traced. His case was dismissed and costs were awarded to the MIBI, which estimates its legal bill will be in excess of €30,000. It emerged in February a garnishee order has been issued against Mr Iosca, who is an unemployed father-of-two. A garnishee order means if he gets a job or comes into money in the future, he will have to use any money received to pay his debt to the MIBI.

In January, he had a failed High Court action where he claimed he suffered considerab­le disruption to his life after his bike was hit by a car – but he was seen on video footage picking up a wheelchair and putting it in his car. He was also recorded removing crutches from plastic wrapping, in footage shown in court. After the footage was shown, he withdrew a High Court action in which he claimed his bike was struck by a car that could not be traced.
