Drinkdrive casedismissed
A 60-year-old Ballycullane motorist who came to grief in a crash after celebrating local election results had a drink drive charge dismissed at Wexford District Court on Monday, May 18.
John Murphy from Ballytarsna, Ballycullane was involved in a single vehicle accident around 8 p.m. on the evening of May 25 last year.
Investigating Garda Eoin Maher arrived at the scene in Ballygarvan to find the accused man’s white Citroen Berlingo van lying on its side. The defendant had blood on his face and appeared to be shaken.
He said at the time that he had been in Morrissey’s pub in Cassagh, celebrating the re-election of Cllr Mick Whelan.
The garda went with him in the ambulance to Wexford General where a doctor agreed that a blood sample could be taken.
Analysis of the blood disclosed a concentration of alcohol over the legal limit for driving.
However, the case was dismissed on by Judge Brian O’Shea, who noted that no evidence had been given that the medic in question was responsible for treating the defendant at the time.
