Man appears in court on Rosses Point assault charge

- By Sharon Dolan D’Arcy

A Wexford man was before a local court charged with assault for punching a man in an unprovoked attack at a pub in Rosses Point on Sunday last. Before Sligo District Court was Tadhg Doyle (40) of Ballinacoola,

Curracloe, Enniscorthy, Co. Wexford, who was charged with a section two assault of Michael Carton at the Yeats’ County Hotel, in Rosses Point on Sunday, August 21.

The court was told that he was also charged with using or engaging in threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace. Sergeant Derek Butler told the district court that the victim was sitting at a table in the bar with his elderly father when the defendant approached him and struck him with a punch. It was an unprovoked attack and the victim said he was unprepared for the assault. In the ensuing struggle that followed, the victim’s father fell to the ground and received a cut to his head.

The attack, which was captured by CCTV on the premises, was obtained by gardai and the defendant identified, subsequently arrested and brought before court.

Defending solicitor, Martin Burke of Martin J Burke Solicitors, Carrickon-Shannon, said his client had accepted his wrong-doing and was seeking finalisation as soon as possible.

THE defendant had to return to Australia on Sunday, September 4 and had made the sum of €5,000 available for the victim as compensation which the victim considered adequate.

Judge Brendan Reilly inquired as to the victim’s injuries. Sergeant Butler said he complained of his teeth being “quite sore” and he had received a lot of dental work on them last year.

Sergeant Butler told the court he had video footage of the incident on his phone which he furnished to Judge Reilly to view. Having viewed the footage, Judge Reilly said he was not comfortable to deal with the matter presently in his court, and what he saw on the phone was “very disturbing.” He said he wanted to receive a statement from the injured party, and also to see what “inspiration” the Director of Public Prosecutions (DPP) had to give on the matter.

He remanded the accused on continuing bail to August 31 for mention at Sligo District Court pending advice from the DPP.
