Woman swore at guards while in hospital

A man accused of assault has been given the benefit of the Probation Act after paying his victim compensati­on and making things up with him. Timothy Gendola (23) of Mulberry Park, Sligo, appeared before Sligo District Court last week charged with assaulting Daniel Michalski and damaging his backpack on June 30, 2020.

Sgt Derek Butler told the court that at 4.30pm that afternoon at the Fairgreen, Collooney, the injured party was sitting on a bench with a friend when Gendola attacked him from behind, got him in a headlock and pulled him to the ground.

He ripped off Michalski's backpack and searched through it.

Tom MacSharry, defending, told Judge Deirdre Gearty that the two men had since met up, shaken hands and full compensati­on had been paid to the injured party by the accused. “My client had got it into his head that there were drugs being used and mistakenly followed a number of youths.

They've since made up. He has one young child and one on the way. He's turned his life around,” said Mr MacSharry, who thanked Garda Darcy for assisting with the reconcilia­tion of both parties.

He added that Gendola had no previous conviction­s or addiction issues. “It was a very unfortunat­e situation. He reacted in a very bad way but it was over three years ago.

“He did the manly thing, he paid the injured party as a gesture of his genuine remorse.”

Judge Gearty gave Gendola the benefit of the Probation Act on both counts.

10. Sgt Derek Butler told Judge Deirdre Gearty that Gardaí were called to the hospital that night because a woman was behaving aggressive­ly towards staff.

They found Brady with a half-bottle of vodka and directed her to leave after staff said she was OK to go.

But Brady told Gardaí to “f *** off” and began kicking out her feet. She was arrested at 9.23pm and said “f *** you, who the f *** do you think you are?” to Gardaí.

Defence solicitor Mr Gerard McGovern told Judge Gearty that the incident was a “source of shame” to his client, who had no previous conviction­s.

“She had an injury and to kill the pain she drank a lot of vodka. She apologises profusely,” he said.

He said Brady's only income was her pension but said she was willing to offer a small contributi­on to the court poor box. Judge Gearty told the court that drinking was no excuse for Brady who had “behaved extraordin­arily badly in a hospital where people were trying to help you.” “They were working under pressure and you come in: a) to be treated and b) behaved like that.

It's very disappoint­ing that Gardaí would have to be called up there,” she told the defendant.

Brady gave a donation of €100 to the court poor box which Sgt Butler suggested could go to the Little Blue Heroes Garda Charity.

The judge gave Brady the benefit of the Probation Act and dismissed the case.
