,¶P a landlord renting out a house to a faPily. :hat are the rules about registerin­g the tenancy" You must register the tenancy with the 5esidentia­l Tenancies Board (5TB) within a month of the tenancy starting. You can register the tenancy online using the 5TB’s online system or you can register by post or email.

:hen you register the tenancy, you need to give detailed informatio­n about the property, including: The address of the rented home

The name, address and PPS number of the landlord, and the name and PPS of each tenant A descriptio­n of the property, and the Building (nergy 5ating (B(5) (if applicable)

The date the tenancy started

The rent and how often it is paid

The local authority area the property is located in

The term of the lease, if it is a fixed-term lease, and if it is a sub-letting

:hat tenancies Pust be registered"

0ost privately rented properties must be registered with the 5TB. This includes properties rented out by approved housing bodies (AHB) and student-specific accommodat­ion.

+ow often do , need to register the tenancy"

You must re-register the tenancy every year that the tenancy continues. This must be done every year within a month of the date of when the tenancy began. The landlord is responsibl­e for registerin­g the tenancy.

The 5TB will remind landlords when annual registrati­on is due if they have up-to-date contact details for the landlord.

You must pay an annual registrati­on fee. The fees are different depending on the type of tenancy. For example, the fees to register an AHB tenancy and a private rented tenancy are different.

The basic fee for registerin­g a private rented, student-specific tenancy or cost rental tenancy with the 5TB is €40 a year. There are exemptions from fees in certain circumstan­ces.

:hat haSSens if , register the tenancy late or if , don¶t register a tenancy at all"

If you register a tenancy late, you may have to pay late fees. The 5TB started charging late fees again on 1 0arch 2024. You can read more about how late fees worN on the 5TB’s website.

If you don’t register a tenancy, you can be fined up to €4,000 and face imprisonme­nt for up to 6 months if you are convicted. A further penalty of €250 for each day the tenancy isn’t registered can also be applied. You will also have to pay the 5TB’s legal costs.
