A 38-year-old motorist who knocked down a pedestrian as he travelled along the Castleblayney Road, has had a careless driving charge struck out.

After hearing evidence, Judge Cheatle remarked this was probably a matter best left to a civil remedy.

He noted the defendant, Andrew O’Neill, 207 Concession Road, Crossmaglen, was insured and didn’t leave the scene.

Sgt Fintan McGroder said that on 7 February last gardaí were flagged down at Philipstown, Hackballscross.

A pedestrian was lying on the grass. It was discovered she had been struck by the wing mirror of a white BMW driven by the defendant, who had stopped immediately.

The victim received treatment at the scene before being taken to hospital by ambulance.

Sgt McGroder said O’Neill was on a straight stretch of road. He was overtaking a vehicle in front of him which caused the collision by pulling out, forcing him to evade it and collide with the pedestrian.

He has no previous convictions.

Solicitor Conor MacGuill added his client’s insurers are dealing with matters.

He said the defendant was completing the overtaking when the other vehicle moved over in front of him.

Judge Cheatle struck out the charge.
