Two days for Healy-Rae case

THE hearing into a full of appeal by the two sons of Independen­t TD Michael Healy-Rae has been listed again for October 5 to set a date for hearing.

The case was adjourned on Monday this week during a call-over of cases due to come before the circuit court in Kerry.

The court was told that he case would be fully contested and would take two days.

At a sitting of the District Court in Kenmare in December, Jackie Healy-Rae, aged 24, of Sandymount, Kilgarvan, and his brother Kevin Healy-Rae, aged 20, also of Sandymount, Kilgarvan, both sons of the TD Michael Healy-Rae, together with their friend Malachy Scannell, aged 34, of Inchinacoo­sh, Kilgarvan, were convicted of assaulting Englishman Kieran James, in Kenmare, on December 28, 2017.

Cllr Healy-Rae received an eight-month suspended sentence and his brother Kevin seven months suspended.

A third co-accused was also convicted.

They are appealing the conviction and the sentence and are represente­d by solicitor Padraig O’Connell.

The case has come before the circuit court on a number of occasions since but has yet to be heard.

This Monday it was put forward to the list again on October 5 when a date for the appeal will be set.

At a previous listing of the case the court heard that the case must be heard in Tralee to allow CCTV to be viewed.

At the same hearing in February the court was told that one of the witnesses could not attend as she was pregnant. She is the wife of Kieran James, the victim of the assault. They both live in London.
