‘ Misleading’ oninsuranc­e

A Judge told a driver that he believed she was misleading the court as regards her insurance.

Before the court was Lisa McCarthy of Tarmon Manor, Castlerea who was summoned for not having insurance at Ballymacar­riga, Ballymote on March 30th last. The defendant was represente­d by Mr Gerard McGovern, solicitor.

He said the defendant had a policy which ran from August 2015 to May 2016 and when it was shown at a previous court the prosecutin­g Inspector appeared to be satisifed with the matter about to be struck out but the Garda got an adjournmen­t as he wished to check the policy out.

The court was told by Garda Feeney that the defendant was not covered by a policy of insurance she had produced. This policy covered another vehicle and would also have covered her driving of another car as long as it wasn’t owned by her.

However, the Garda said the car in which she was stopped in was also registered in her name.

The defendant told the court she was given a lend of this car as her other car was being repaired by this man in advance of an NCT.

He gave her the car to get her around.

Judge Kevin Kilrane said he could not understand why this second car had been put into her name.

The defendant said the man, a family friend, didn’t relaise the car had been put into her name.

Judge Kilrane said the defendant was misleading the court and traded on confusion, using it as a defence. “It’s just utter confusion,” he said. The court was told McCarthy had a previous conviction in 2014 for not having insurance and NCT.

Judge Kilrane said the defendant didn’t become the registered owner of the second car “on a whim.”

She had told the car she sent it to a scrapyard and then said two men had come to collect it.

“She ( defendant) should face up to these things,” he said.

He imposed a € 300 fine, adding that she had been lucky.

Inspector Paul Kilcoyne said the defendant was removed from Toff’s Nightclub at 2.30am and she was then observed pulling at the wipers of a car outside which belonged to Ms Hirschehma­nn.

Security staff, including the victim approached Brady who lunged at her, biting her above the eye and holding her grip for about a minute. Brady also punched and kicked her.

Mr Tom MacSharry, solicitor ( defending) said there was a full and frank probation report before the court on Brady who was expecting her first child.

On the night she had a lot of alcohol on board which was mixed with medication. Mr MacSharry added that the assault had been savage in nature.

Judge Kilrane remaned Brady on continuing bail to October 19th for continuing monitoring and for a further report. The defendant was also to be subjected to probation supervisio­n in the meantime.
