Revenue ‘ must show understand­ing’

THERE must be some understand­ing by Revenue for some people’s circumstan­ces, Judge Kevin Kilrane stated at Sligo District Court. He dismissed a prosecutio­n by Revenue against a man for failing to make tax returns. Brian Kilgarriff of Bricklieve, Castlebald­win was summoned for failing to make returns for the end of the tax year in October 2010, 2011 and 2014. He was represente­d by Ms Laura Spellman, solicitor. State Solicitor, Mr Hugh Sheridan said the case had been adjourned for a number of months in order to allow Mr Kilgarriff contact Revenue. Mr Kilgarriff said Revenue was to send him a two or three page document outlining what he was to do but instead sent him several pages. Asked where he was living, Mr Kilgarriff said he was still homeless since separating ten years ago. He stayed with friends. Judge Kilrane said: “On reading a doctor’s report, he has serious problems Mr Sheridan. In the circumstan­ces there must be some understand­ing for a man like him who rapidly went down hill for whatever reason and in the circumstan­ces I will strike out these matters.”
