-

A 32-year-old man who was removed from a pub went to his car and returned with a pick axe handle.

When Gardaí arrived at Stephen Street, Patrick Dwyer, with an address in Cork and formerly of Cartron, Sligo had put the pick axe handle in a nearby bin.

Dwyer had been put out of the pub at 2.20am on November 4 th 2011 2015. The defendant, who has 57 previous convictions, was also summoned for driving without insurance at Pearse Road on the same night. He was banned at the time.

Mr Gerard McGovern, solicitor (defending) pleaded that Dwyer was the father of an eight year old child and was presently serving a sentecne with a due date of November 4 th. “I’m asking for leniency, he’s still a young man,” said Mr McGovern.

Judge Kevin Kilrane jailed Dwyer for four months and banned him from driving for ten years. He said the incident with the pick axe handle was serious with malice aforethought involved..
