Driver entitled to tax exemption on disability

A driver whose tax was out for nine months had been entitled to an exemption due to his disability but he hadn’t got around to doing the necessary paper work, his solicitor told Sligo District Court. Before the court was Edward Gray of 22 St Edward’s Terrace who was summoned for not having tax displayed on his Ford Focus when stopped at Holborn Hill on June 11 th last by Garda Kieran Higgins. The Garda told the court that the last tax had expired at the end of September 2016.

Gray failed to pay a fixed charge penalty notice that was subsequent­ly issued said the Garda. He told Mr Mark Mullaney, solicitor (defending), that he wasn’t aware at the time that the defendant was disabled and would therefore have been entitled to a tax exemption.

Mr Mullaney agreed with Judge Kilrane that the defendant should have had the necessary paper work filed in order to qualify for this. Mr Mullaney said Gray’s present car was taxed to the end of this month.

The Probation Act was applied.
