€10k for child injured after bicycle ‘fell apart’

A young girl who injured her knee after falling from a new bicycle which allegedly had ‘fallen apart’ was awarded €10,000 by Judge Kevin Kilrane in a settlement approved at the District Court.

The girl, now aged 7, was injured when falling off her bicycle on June 7 th 2017. The girl sued Halford’s Limited through her mother.The bike was bought at its store at Sligo Retail Park, Carraroe and the court heard it had started to “break apart and fall apart” resulting in the plaintiff falling to the ground.

The girl presented for medical attention two weeks after the accident on June 20 th after she complained of knee pain. Treatment consisted of rest, cold compressio­n and elevation.

Mr Keith O’Grady BL with Mr Tom MacSharry, solicitor (for the plaintiff ) said Ibuprofen was prescribed and the girl used crutches for a awhile and missed a few days from school. Her sleep was disturbed initially but had since settled.

The plaintiff ’s knee would get sore with exercise but her injury had resolved itself within four to five months of the accident.

Mr O’Grady said the defendants had made an offer of €10,000 and he and the child’s mother were happy to accept this.
