Driver was 11 times over drink drive limit

A driver who was eleven times over the legal drink drive limit was fined €300 and banned from driving for four years by Judge Kevin Kilrane at Sligo District Court.

Before the Court was Kamil Milczarek (35) of 4 An Tard, Circular Road who admitted a charge of drunk driving on December 14 th 2017 at Tobers canavan.

Inspector Paul Kilcoyne told the court that a reading from the defendant showed a concentrat­ion of 108mgs of alcohol per 100mls of breath. He has 14 previous conviction­s, the last being in 2010 when he was banned for four years for not having insurance. There was also a previous drunk driving conviction in 2009 along with a conviction for driving without insurance.

Judge Kilrane said the defendant was eleven times over the legal limit. Mr Mark Mullaney, solicitor (defending), pleaded that the defendant was the holder of a learner permit.

“He tells me that on the day in question he had been evicted from his house where he had been drinking and he did end up driving to a friend’s house.

“He does have a difficulty with alcohol. He does work, holding down two jobs and is the father of an eight year old child,” he said.

Judge Kilrane commented that the reading was shocking. He fined the defendant €300 and imposed a four year ban. The Judge added that evidence of the defendant’s drinking habits would have to be looked at in advance of any applicatio­n to restore his licence in time.

“You are quite a danger on the road,” the Judge told the defendant, refusing a request to have the commenceme­nt of the imposition of the ban postponed.

“If he went out in a week’s time for a final fling and injures someone, who will get the blame? Not you Mr Mullaney or him. You know who will get the blame” - Judge.

The Judge told the defendant that he lacked responsibi­lity. “I’ve a duty to protect the public from this irrational kind of drinking,” he said.
