FORESTRY (PLANNING PERMISSION) AMENDMENT BILL 2018
AN ACT TO AMEND THE PROVISIONS OF THE FORESTRY ACT TO PROVODE FOR PLANNING PERMISSION FOR ALL FORESTRY DEVELOPMENTS OVER FIVE HECTARES; TO AMEND THE FORESTRY ACT 2014; AND TO PROVIDE FOR RELATED MATTERS.
Be it enacted by the Oireachtas as follows: Interpretation
1. In this Act
“Afforestation” means the conversion of land to a forest.
“Principal Act” means the Forestry Act 2014.
“The Minister” means the Minister for Agriculture, Food and the Marine.
“The Applicant” means the person, or persons, or entity, applying for an afforestation licence under section 22 of the Forestry Act 2014. (2) The Minister may introduce such regulations as are necessary, incidental, supplementary or consequential for the purposes of giving effect to this section.”
Amendment to Section 4 of the Planning & Development Act 2000
3. Section 4 of the Planning and Development Act 2000 is hereby amended by the insertion of the following subsection into section 4(1) of the act at the conclusion of 4(1):
“(m) Notwithstanding the generality of the foregoing nothing in this section shall prevent the introduction of regulations providing for a requirement for planning permission for afforestation.”
