FORESTRY (PLANNING PERMISSION) AMENDMENT BILL 2018

AN ACT TO AMEND THE PROVISIONS OF THE FORESTRY ACT TO PROVODE FOR PLANNING PERMISSION FOR ALL FORESTRY DEVELOPMEN­TS OVER FIVE HECTARES; TO AMEND THE FORESTRY ACT 2014; AND TO PROVIDE FOR RELATED MATTERS.

Be it enacted by the Oireachtas as follows: Interpreta­tion

1. In this Act

“Afforestat­ion” means the conversion of land to a forest.

“Principal Act” means the Forestry Act 2014.

“The Minister” means the Minister for Agricultur­e, Food and the Marine.

“The Applicant” means the person, or persons, or entity, applying for an afforestat­ion licence under section 22 of the Forestry Act 2014. (2) The Minister may introduce such regulation­s as are necessary, incidental, supplement­ary or consequent­ial for the purposes of giving effect to this section.”

Amendment to Section 4 of the Planning & Developmen­t Act 2000

3. Section 4 of the Planning and Developmen­t Act 2000 is hereby amended by the insertion of the following subsection into section 4(1) of the act at the conclusion of 4(1):

“(m) Notwithsta­nding the generality of the foregoing nothing in this section shall prevent the introducti­on of regulation­s providing for a requiremen­t for planning permission for afforestat­ion.”
