No con­vic­tion as unau­tho­rised pon­toon on Slaney es­tu­ary re­moved

A PON­TOON in­stalled on the Slaney es­tu­ary at Fer­rycar­rig, Wex­ford, was an ‘unau­tho­rised de­vel­op­ment’, the District Court was told.

Pros­e­cu­tion of De­clan Power, Park, Fer­rycar­rig was taken by Wex­ford County Coun­cil where the ac­cused was de­fended by solic­i­tor Sean Lowney.

Mr Lowney made sure that Judge Ger­ard Haughton was made aware of the lo­ca­tion in ques­tion.

He re­ferred to where ‘ele­phants and other wild an­i­mals’ may be found by the river.

The court was as­sured that the pon­toon had been re­moved and the site re­stored by Power, who works col­lect­ing crashed cars from the road­side.

Mr Lowney also con­firmed that the lo­cal author­ity’s ex­penses had been paid in full.

Judge Haughton in­di­cated that he would not record a con­vic­tion once the of­fender makes a €500 con­tri­bu­tion to the ISPCA.
