Case dismissed

A MOTORIST successful­ly pleaded not guilty to a motor tax summons dealt with at Wexford District Court.

A fixed charge penalty notice was issued in the post to 27-yearold Stephen Davis at the address 3 The Malthouse, Castlebrid­ge.

This followed the seizure of his Honda Civic by Garda Niall Brophy at Drinagh on October 19 last.

The garda told that court that it appeared the tax had been out on the vehicle since August of the previous year.

Davis’s defence was based on the fact that he did not receive the fine issued to him in the post.

He explained that after the car was impounded in Drinagh, he moved to Clonard and later to Curracloe.

In the end, he was served a summons to come to court when it was handed to him at the petrol station in Tesco.

Judge Brian O’Shea reminded him that he was required to notify the licensing authority of any change of address.

However, it was accepted that the summons was served too late to allow Davis pay a fine and avoid having to come to court.

Case dismissed.
