Sus­pended term for mo­torist who didn’t help oth­ers

DANGER­OUS DRIV­ING led to a sus­pended jail sen­tence and a two year dis­qual­i­fi­ca­tion for Jerry Wall from 75A Moun­tain View, Bal­lyguile, Wick­low Town.

The ac­ci­dent oc­curred on the M11 mo­tor­way at Tober­duff on Au­gust 4 last year and re­sulted in in­juries to all three peo­ple aboard the car which he rear-ended and pushed into the cen­tral bar­rier.

Con­sid­er­ing the mat­ter at Gorey Dis­trict Court, Judge Ber­nadette Owens noted that Wall failed to ren­der as­sis­tance to the ca­su­al­ties and left the scene.

She noted that the ac­cused had pre­vi­ous con­vic­tions for hit and run and for mo­tor in­sur­ance of­fences, though he pre­sented him­self to Gorey garda sta­tion sev­eral days af­ter the ac­ci­dent.

The court also noted that two of the de­fen­dant’s chil­dren had sig­nif­i­cant health dif­fi­cul­ties and it was ac­cepted that he was fully in­sured on this oc­ca­sion.

The judge reck­oned that the of­fence mer­ited a four month jail sen­tence, which was sus­pended, along with a two-year driv­ing ban.
