Answer: Yes, you are entitled to your indemnity. Not only that, as you have worked for over 10 years you should get your full indemnity according to the Kuwait Labor Law enacted in February 2010.

The calculatio­n of your indemnity will be as follows:

1. First five years 15 days remunerati­on for each year = 15 x 5 = 75 days ÷ 26 = 2.88 months remunerati­on 2. For the rest of the period, 1 month’s remunerati­on for each of the 8 years = 8 months remunerati­on 3. Total indemnity = 8+2.88 = 10.88 months remunerati­on = 10.88 x 450 = KD 4,896 As you have worked for over 10 years, you should get the whole above amount even if you have resigned.

According to the Labor Law, if you resign after 3-5 years service, you get 50% of the indemnity; if you quit after more than 5 years but less than 10 years service, you get two-thirds of the indemnity and if you resign after 10 years you get the full indemnity.

In case you are terminated, you get full indemnity calculated in the same way as above, regardless of period of service.

I have been working in a private firm for the last 13 years and my salary is KD 450. Now I have resigned with a proper notice of 3 months. Will I be entitled to any indemnity and if so what will be the calculatio­n?
