Verdict in which woman ordered to pay KD 6,000 to friend overturned

Citizen’s acquittal in drugs case upheld ‘Decision final’

KUWAIT CITY, April 1: The Court of Appeals presided over by Judge Emad Al-Huwail overturned the verdict issued by a lower court which obliged a Kuwaiti woman to pay KD 6,000, which is the value of gold jewelry, to her friend. The court instead rejected the case, indicating that the customary agreement between the two parties fell short on payment agreement.

Lawyer Khaled Mubarak, who filed the appeal on behalf of the Kuwaiti woman, said the plaintiff was not issued with a court order that obliges his client to pay KD 6,528 for the jewelry, stressing that the customary agreement signed between the two parties did not include any clause on repayment.

The court insisted that it would be injustice to force the Kuwaiti woman to pay the money because there was no clause in the agreement that obliges her to do so.

The Criminal Court of Appeals presided over by Judge Ibrahim Al-Obaid upheld the verdict issued by a lower court which acquitted a Kuwaiti citizen of possessing drugs and weapons.

During the court session, the defense counsel Lawyer Mohammad Al-Mutairi insisted that the procedures followed for arresting his client were illegal and the case file did not include any evidences against his client.

Following the session, Lawyer Al-Mutairi affirmed that the verdict issued by the court to acquit his client confirms the fact that the State of Kuwait is a country of law and institutio­ns.

The Court of First Instance presided over by Judge Saud Al-Maimouni acquitted a bank employee of fraud and deception against a client by assisting her in securing a loan for financial benefit.

The case file indicated the defendant swindled the plaintiff of a certain sum by giving her the impression that he could assist in paying back a previous loan to make it possible for her secure a new one. The plaintiff claimed that the defendant followed her to a finance company where he used his credit card to pay for the loan on her behalf and obtained a fake receipt before asking her later to make another payment.

At the court session, the defense Lawyer Ali Al-Ali insisted that betrayal of trust involve financial and moral aspects which are insufficie­nt in this case. He faulted the investigat­ive procedures carried out by the detectives, stressing that they did not reach the core of the issue in order to obtain the facts.
