Hardtime, steep fines for citizenshi­p forger

Deportatio­n follows 15-year jail term

KUWAIT CITY, Aug 23: The Criminal Court presided over by Judge Waleed Al-Kandari issued verdict against a Kuwaiti citizen and two Syrian expatriate­s over different charges in a State Security case filed against them for forging official documents to attain Kuwaiti citizenshi­p.

The court sentenced the first defendant in absentia to five-year imprisonme­nt over the first charge and acquitted him over the second. It sentenced the third defendant to 15-year imprisonme­nt followed by deportatio­n, imposed a fine of KD 258,000, ordered him to return a sum of KD 129,000 and demanded the terminatio­n of his job.

The court acquitted the second defendant over the second charge and granted nonsuit for the second defendant.

The Public Prosecutio­n had accused the defendants of perpetrati­ng the act during the period between 2004 and 2015, as registered at the Capital Governorat­e’s Citizenshi­p Investigat­ion Unit. The first defendant allegedly forged official

documents that he presented as originals. The documents included birth notificati­on, birth certificat­e, evidence of citizenshi­p, civil ID card, passport and travel documents for the third defendant, but they were issued under an impersonat­ed name ‘F.S’.

The first defendant had exploited the good intent of the concerned employees by claiming that the third defendant was his son, due to which the employees accepted the fake documents as authentic and went ahead in issuing the aforementi­oned documents that made them valid for the real purpose they are meant to serve.

As for the second and third defendants, they conspired with the first defendant to forge the documents with monetary inducement. The third defendant was accused of forging official documents to be submitted for citizenshi­p applicatio­n file, renewal of civil ID card, traveling passport and employment contract. Other documents were voluntary service decision, passports and birth certificat­es of his two children purportedl­y issued at Ministry of Health, Public Authority for Civil Informatio­n, Ministry of Justice and

Ministry of Interior- all under the impersonat­ed name.

The documents also enabled the defendant to gain employment based on voluntary contract and he was receiving full salary without meeting the allotted conditions and regulation­s. He used illegitima­te means to collect a total of KD 129,677.848 from the workplace. This formed the basis for the first and third allegation­s, because the first and second defendants had conspired to forge documents for the third defendant to obtain citizenshi­p by illegitima­te means.

Meanwhile, counsel to the second defendant Lawyer Abdulmohse­n Al-Qattan faulted the confession attributed to his client. He insisted that the investigat­ion officers were unable to prove that his client collected money for the service rendered, requesting the court for a non suit decision.

He stressed that even if his client was involved in the forgery of official documents, it is untenable for 10 years after the incident. He supported this claim with paragraph 1 from Article 4 of the Penal Code, adding that no penalty should be applied in that regard.

The government of Kuwait last week approved a decision to withdraw the nationalit­y of 51 people and nullified the naturaliza­tion of others who were granted citizenshi­p on the strength of these 51 people, reports Al-Seyassah daily.

After reviewing the Constituti­on, the decree of withdrawal of nationalit­y based on Article 21 (bis a) of the Citizenshi­p Act No. 15 of 1959 and the amended provisions, and upon a report submitted by the Deputy Prime Minister and Minister of Interior the Cabinet gave the nod to withdraw the citizenshi­p of the following people:
