Woman must pay company cash as lawsuit dismissed

KUWAIT CITY, Dec 30: The Commercial Court dismissed a lawsuit filed by a Kuwaiti woman who demanded the cancelatio­n of a company contract that obliges her to pay KD 170,000.

According to the case file, the complainan­t had bought from the defendant 75 percent shares of a company at a cost of KD 200,000 of which she paid KD 30,000 in advance and agreed to pay the rest in installmen­ts. Once she took over the company, she failed to manage it properly and then claimed that the defendant had cheated and deceived her into believing that the company is quite profitable and has a large customer base. She resorted to the courts to cancel the contract so that she can recover her money.

However, the defense counsel Lawyer Ahmad Falah Al-Kulaib presented documents and other evidences to prove the profitabil­ity of the company. He affirmed that the buying and selling of the company was completely done officially and legally through Ministry of Justice and Ministry of Commerce and Industry.

He added that his client could not cheat because he has a reputation to protect and is a member of several joint stock companies as well as the

managing director of an investment company with capital exceeding KD 25 million.

The court ruled in favor of the defendant based on the evidences produced and dismissed the lawsuit, obliging the plaintiff to pay the remaining amount as well as the legal fees.

Petitions adjourned:

The Constituti­onal Court presided over by Judge Yousef Al-Mutawa adjourned 18 electoral petitions from the Fourth Constituen­cy to Jan 24 for the opposition to examine details of the elections.

The court has seconded two judges, Khaled Al-Waqayan and Ibrahim Al-Saif to the Parliament to open the ballot boxes and take out the committees’ report.

The petitioner­s include Fawaz AlAzmi, Hussain Muzeid, Mohammad Tana, Sultan Al-Shammari, Naef Al Mutairi, Bandar Al Mutairi, Mubarak Al-Khureinej, Marzouq Khalifa AlKhalifa, Abdullatif Al-Munawer, Faraj Al-Arbeed, Mufrej Shulahi, Mohammad Nasser Al-Barrak, Mohammed Saad Al-Mutairi, Farz AlDaihani, Mubarak Al-Waalan and Hussein Al Waqayan.

For his part, MP Marzouq AlKhalifa demanded sorting again and collecting ballot boxes to recount votes from the Fourth Constituen­cy, and Candidate Mubarak Al Waalan requested nullificat­ion of the elections and subsequent results, while other candidates echoed the same complaints and demanded recounting of votes.
