Company fined in failed apartment deal

KUWAIT CITY, April 25: The Civil Court ordered a company to pay KD 32,000 compensation for failure to complete the deal for selling an apartment in the United Arab Emirates.

According case files, the plaintiff signed an agreement with the company to buy an apartment in the UAE for KD 26,000. He paid the amount requested for the purchase but the company did not deliver the apartment despite repeated requests to do so.

This prompted the plaintiff’s lawyer, Attorney Mohammad Hamza, to send a written warning to the defendant to deliver the apartment. After a long wait without any response, the lawyer filed a case on behalf of his client demanding for additional compensation for damages.

‘Docus to be seized’:

A legal study revealed that court verdicts on citizenship forgery cases stipulate confiscation of fake documents even if a case falls through due to statute of limitations according to Article 78 of the Penal Code, reports AlJareda daily.

Attorney Husain Al-Abdullah edited the study which states that those who got statute of limitations verdicts will not be able to use them in the Administrative Court because the latter deals only with acquittal decisions; in addition to the fact that the government, represented by the Ministry of Interior, submitted such lawsuits to the Public Prosecution.

The study said the Court of Cassation stressed the need to confiscate fake documents. It added the function of the administrative judge is limited to ensuring that decisions on the cancellation of citizenship are issued by the relevant body, according to the law and there is no abuse of power. The administrative judge must also guarantee that lawsuits are included in acts related to withdrawal of citizenship.

The study is based on the opinions of a number of constitutional

experts including Dr Othman Khalil who supervised drafting of the Constitution. He affirmed the judiciary is authorized to scrutinize citizenship cancellation decisions.

Man dies in mishap:

An Egyptian expatriate died when his heavy vehicle collided with another on Kabad Road near Vegetable Market, says Al-Seyassah.

According to security sources, when the Operations Room of Ministry of Interior received information about the accident, securitymen, paramedics and firefighters rushed to the location.

They pulled out the Egyptian driver who was trapped inside his vehicle and discovered that he succumbed to serious injuries. His corpse was referred to the Forensics Department.

Two other individuals who sustained injuries in the accident were referred to Farwaniya Hospital for

treatment.

Shipment doubted:

A shipment arriving from Turkey has been temporarily confiscated by the Customs officers at the Shuaiba port, reports Al-Rai daily.

The daily added, the concerned authorities acting on information that the goods are Israeli products confiscated the shipment and sent it to the intellectual property department to verify its origin and decide whether to release it or not.

According to a security source the Customs officers had received a tipoff from an unidentified source that the goods are Israeli made.

However, the Al-Shahed daily said the goods are of Israeli origin and have been confiscated.

Cash stolen from car:

Police are looking for an unidentified person for stealing KD 9,000 from the car

of a Syrian, reports Al-Anba daily.

According to the victim, he had parked for a few minutes in front of a pastry shop and when he returned the money was gone.

Police believe a gang is active which is following people leaving the bank with envelopes containing cash. Personnel from the Criminal Evidences Department lifted fingerprints to identify the two thieves.

Youth arrested:

Police have taken into custody a GCC youth in a case of arson, reports Al-Rai daily.

The daily added, the suspect reportedly set fire to the garbage bins in several areas of Jahra, Saad AlAbdullah and Sulaibikhat.

The daily added, the firemen in the area were exhausted because they received calls one after another.

According to police the youth reportedly set fire to about 30 garbage bins. At the time of arrest he was under the influence of drugs.
