Court grants woman custody of her 3 children

KUWAIT CITY, May 23: The Counseling Chamber at the Constituti­onal Court dismissed a petition filed by attorneys Mona Al-Arbash and Hanan Al-Anzi against the law which prevents the children of Kuwaiti women married to foreigners from inheriting real estate

properties.

It also dismissed the petition against a stipulatio­n that Kuwaiti widows cannot avail housing care services if they get married before the issuance of a decision on their housing grant.

Meanwhile, the campaign for supporting the citizen’s family which includes 11 general benefit societies issued a statement affirming their trust in the judiciary, indicating they will continue to exert tremendous efforts in order to ensure that all Kuwaiti women receive their full rights.

Woman gets custody of kids:

The Personal Status Circuit of the Court of First Instance gave a Kuwaiti woman the custody of her three children even though their father had submitted pictures to mislead the court into believing that the behavior of his estranged wife was very bad and she could not be trusted.

In a lawsuit filed by lawyer Haya Al-Dousari on behalf of the Kuwaiti woman, she affirmed that her client was married to the man and they had three children together. Considerin­g the fact that the father abstained from the well-being of their children and other expenses, Lawyer AlDousari wondered how he could accuse the mother in such a manner especially since she was taking care of the children.

Based on the School of Imam Al-Malik, Lawyer Al-Dousari insisted that the father should fend for his children even though the mother was rich.

The court obliged the father to pay for the three children’s expenses, monthly house rent, house furniture and wages of housemaid as well as the expenses for hiring and bringing the housemaid.

Citizen acquitted:

The Misdemeano­r Court acquitted a Kuwaiti man of forcing his friend to sign a document of trust for KD 55,000 at gun point.

According to details of the case as presented by the defendant’s counsel Attorney AbdulWahab Bin Salamah, the plaintiff claimed that he visited the apartment of his client. He said his client was accused of bringing out the weapon with which he threatened to kill the plaintiff and kidnap his children.

The lawyer argued that the allegation­s against his client are nothing but lies and misreprese­ntation of the reality, because there was no documented evidence to back the claim. He added the plaintiff even delayed lodging a complaint regarding the supposed incident. The vehicle used by the duo to steal the 2 safe deposit boxes and which was later

set on fire.
