Man acquitted in drugs case, violating red light

Not guilty in assault issue

KUWAIT CITY, Aug 24: The Criminal Court acquitted a citizen of possessing and consuming intoxicants (Methamine and Amphetamine), driving under the influence of drugs and crossing the red light.

Case files indicate the Public Prosecution charged the citizen with possession and consumption of drugs, driving under the influence and crossing the red light.

The arresting officer testified that while he was at a crossroad, he noticed a vehicle crossing the red light so he chased it. He asked the driver, a Kuwaiti, to stop and demanded for relevant documents but the latter failed to present identification documents. He then noticed that the citizen was in abnormal condition and was uttering nonsensical words.

The officer searched the citizen before leading him to the police car. This led to the discovery of a packet of cigarettes which contained a small parcel with suspicious substances. He referred the citizen to the Drug Control General Department.

Attorney Esmat Al-Kharboutly, lawyer for the accused, faulted the arrest and search procedures as they were taken on the basis that the citizen appeared to be in abnormal condition. She told the court the accusations are malicious while there is no established connection between her client and the discovered intoxicants.

She also argued that the urine and blood samples were taken illegally so the results are invalid according to the recent verdict of the Court of Cassation. She demanded for acquittal of her client due to the absence of incriminating evidence and questionable procedures.

The Court of Appeals has acquitted a woman of allegedly hitting the daughter’s sensitive body parts.

Al-Hajeri denied the allegation against his client and maintained it’s a tissue of lies. He stressed the woman’s ex-husband created the allegation to set his client up for reasons best known to him. He insisted preliminary medical reports were not enough to establish the case against his client.

Lawsuit filed:

Director of Portfolio at Kuwait Investment Authority (KIA) has filed a lawsuit against the Council of Ministers and Ministry of Commerce and Industry to nullify the appointment of board members of the National Fund for Support and Welfare of Small and Medium Projects.

The plaintiff claimed the ministerial decision issued by the Council of Ministers concerning the appointments violated law, and cited lack of requisite experience to manage welfare of small and medium projects since the appointees did not work with any agency, department or company relevant to support, funding and welfare of small and medium projects — according to provisions of the law governing establishment of the fund.

He stressed failure to publish curricula vitae of the appointees was to put the public in the dark and to mislead them, and cited Article 4 of Law No. 98/2012 concerning establishment of the National Fund for Support and Welfare of Small and Medium Projects.

Verdict upheld:

The Sixth Civil Circuit of the Court of Appeals presided over by Judge Sultan Buresli upheld the verdict issued by the Court of Appeals which ordered Fuad Al-Rifai to pay KD 4,000 to Lawyer Mubarak Bader Al-Yaqoub as compensation for moral damages and legal fees.

Al-Yaqoub had sued Al-Rifai for tarnishing his image through a statement the latter posted on his Twitter account in which he offended the personality of Al-Yaqoub.

During the court session, Al-Yaqoub expressed the implications of Al-Rifai’s actions, and the court issued a ruling in his favor.
