Non-Kuwaiti loses cash suit
KUWAIT CITY, Oct 8: The Court of Appeals nullified the verdict of the First Instance Court that sentenced a Kuwaiti man in absentia to five years in prison with hard labor for allegedly possessing hashish and Methamphetamine for consumption purpose. The court thereby acquitted the suspect of all charges.
The prosecution officer stated he was on a routine security surveillance of the area when he sighted the suspect with another man in a vehicle parked at a suspicious location. He approached the duo for identification, but observed they were jittery and found it difficult to make meaningful statements. The officer then saw a black scale on top of which was a small sachet containing white substance inside the car.
He confronted both suspects and they admitted ownership of the substance. The officer referred them to the concerned authority.
Lawyer Abdul-Mohsin AlQattan in their defense countered the allegation and faulted the procedures leading to the search and arrest of his client. He urged the court to declare his client innocent of the allegation.
Lawsuit dismissed: The Court of First Instance chaired by Judge Yousef Aledhan dismissed a lawsuit an expatriate filed against his estranged Kuwaiti wife demanding KD 270,000 and ordered the plaintiff to pay legal fees and other expenses.
The plaintiff claimed his exwife owed him the aforementioned sum and insisted he loaned her the money to buy a house for the two of them but she registered it in her name, because he’s a non-Kuwaiti. Lawyer Mohammad Al-Mutairi defending the estranged wife argued that her client bought the house with her own money, and challenged the plaintiff to prove his claim. He supported the argument with Article 263 of civil law.
