Lawyer Hani ordered to be released sans bail in case filed by MP
Court orders woman to return full dowry to her husband in at-fault divorce ruling
KUWAIT CITY, April 21: The Court of Appeals ordered the release of Lawyer Hani Hussein without bail in a case filed against him by MP Jama’an AlHarbash for allegedly offending him through messages Lawyer Hussein had posted on Twitter. The court also ordered to adjourn the case until September to summon the case officer.
Earlier, the Court of First Instance had sentenced Lawyer Hussein to three-month imprisonment after investigations by the case officer showed that the defendant admitted the account, in which the messages deemed offensive to MP Al-Harbash were posted, belonged to him. However, he had denied that the messages were not intended for Al-Harbash, clarifying that he had mentioned former MP Muhammad Al-Juwaihil, and not AlHarbash in the messages.
Representing Lawyer Hussein was Lawyer Jaleel Al-Tabbakh who disqualified the investigation report and urged the court to release his client on bail worth any amount as deemed fit.
Lawsuit filed:
Attorney Emad AlSeif on behalf of HH Sheikh Nasser Al-Muhammad filed a lawsuit against a blogger identified as (N.J.) for posting tweets deemed offensive to Sheikh Nasser via social media.
Al-Seif said the tweet received loads of comments, as it targeted Sheikh Nasser, and the blogger is liable to punishment according to Article 70 of Law No. 37/2014 regulating communication and information technology.
He added the aforementioned article stipulates no less than one year imprisonment term and fine ranging from KD 200 to KD 2,000 or any of the two punishments against whosoever misuses communication.
‘Return dowry to husband’:
The Family Court ordered a Kuwaiti woman to return her dowry in full to her husband after the court issued an atfault divorce ruling.
Representing the husband was Lawyer Thamer Mubarak who explained that his client and his wife were married in a legally binding wedding ceremony but she refused to consummate the marriage, and her family supported her position without any reason that allows her to do so.
His client used all possible means to settle the issue amicably, which rendered him to endure major moral and financial damages. Eventually, he was forced to file a case against his wife to demand her to return the dowry of KD 5,000 that was given to her, as well as to pay the legal charges of the case.
The court based its verdict on the fact that the marriage was not consummated and that the two had not even entered in any position which might lead to suspicion of consummation, due to which the husband deserves to receive the value of dowry in full.
