60 real-estate complaints referred for probe

KUWAIT CITY, Oct 21: The Civil Circuit of the Court of First Instance ordered a Kuwaiti citizen to pay KD 20,000 to the parents of his friend who died in a traffic accident caused by the citizen.

According to the case file, the defendant was driving his car recklessly with the victim as his passenger when he met with an accident, which resulted in the death of the victim.

Lawyer Abdullah Al-Alanda said the defendant was accused by the Traffic Misdemeano­r Department of causing the death of his passenger, who is the son of the plaintiff. The court said the defendant has to pay compensati­on to the victim’s family since it is proven that he is responsibl­e for the accident.

‘Refund appraisal sum’: The Administra­tive Court has instructed the Ministry of Finance to refund the appraisal sum in return for expropriat­ion of a property whose value was reduced by the Objections Committee in favor of several real estate owners, reports Al-Qabas daily.

The court affirmed the ministry is not authorized to submit an objection to compensati­on, rejecting a government­al request to declare the unconstitu­tionality of Article 16 of Law Number 33 for the year 1964 on the expropriat­ion of properties.

Commenting on the verdict, Attorney Dr Mohammad Monawer asserted the court won the legitimacy as it declared that the government’s defense with regard to the unconstitu­tionality of the article which limited the objection right to owners of real estates lacks merit.

Probe on 60 complaints: Ministry of Commerce and Industry has referred to the Public Prosecutio­n 60 real-estate related complaints lodged against two companies including a money exchange company, reports Al-Rai daily quoting informed sources.

They explained that the ministry received 19 complaints related to real-estate swindling worth KD 5 million lodged against one of the companies. It received 41 complaints related to real-estate swindling of the same value against the second company. Necessary investigat­ions were conducted which revealed that these complaints are valid.

The two companies have a previous judicial file based on similar complaints which is open. The total amount in all the complaints referred by the ministry in this regard is more than KD 10 million.

The sources said Ministry of Commerce and Industry recently conducted a study of the submitted complaints and did not find any role in dealing with them as it is related to disputes concerning contracts which are to be filed directly with the Public Prosecutio­n by the complainan­ts without the ministry’s interventi­on.

They affirmed that the ministry is on the verge of taking new strict actions to avoid new fraud operations.
