Court dismisses case against investor

Refaei gets 7 years in jail

KUWAIT CITY, Dec 12: The Court of Cassation dismissed a lawsuit filed by a trading company against a Kuwaiti investor at Qurain Markets. The final ruling nullified the verdict of the Court of First Instance upheld by the Court of Appeals, which ordered the defendant to pay over KD10,000 rent values covering the period of using the shops in contention until the time of eviction.

Lawyer Ali Al-Ali, counsel to the citizen, disclosed that his client rented shops from the company since 2009 for KD 190 per month but refused to pay the rent until the time of litigation, because the company breached an agreement concerning the renewal of license. He said witnesses testified that the man didn’t make use of the shops since Kuwait Municipali­ty issued notice of the violation, saying the location was meant for vocational activities rather than trade. He pointed out that the company misled his client and many others by encouragin­g them to invest there.

Jail for preacher:

The Criminal Court has sentenced religious preacher Fuad Al-Refaei to 7 years imprisonme­nt with hard labor and a fine of KD100,000 for violating national unity law and instigatin­g sectarian sedition-actions that could lead to hatred in the Kuwaiti society- according to lawsuit filed by the Cyber Crimes Department against him.

The Public Prosecutio­n Department charged Al-Refaei for posting tweets to incite hatred by demeaning a particular sect in society by mocking their belief, rituals and teachings.

Wedding annulled:

The Family Unit in the Appeals Court annulled the marriage contract of a citizen after the discovery of his mental illness which made him ineligible for marriage, reports Al-Anba daily.

This came after a female citizen sued her father-in-law, demanding for annulment of her marriage contract with his son, to grant all her legal rights and oblige him to shoulder the expenses and lawyer’s fees.

In her lawsuit, the woman revealed she discovered that her husband is suffering from mental illness and his father hid this informatio­n from her.

Dec 19 hearing set:

The Committee for Appeals at the Constituti­onal Court chaired by Counselor Yusuf Al-Mutawa has set Dec 19, 2018 to look into the appeal filed by attorneys Yusuf Al-Adwani and Fayez Al-Zefairi on the constituti­onality of procedures for fighting money laundering and financing of terrorism based on the second chapter of law number 106/2013 concerning the Kuwaiti Financial Investigat­ion Unit.
