Doctor fined in surgery case

‘Continue grant for girl’

KUWAIT CITY, Feb 13: The Court of Cassation imposed KD 10,000 fine on a doctor for failure to inform a Kuwaiti woman, who suffered from minor paralysis after giving birth at a public hospital, about the repercussi­ons of surgery.

Although the court confirmed that there was no medical error, it stressed the need for doctors to inform patients about the danger or consequenc­es of a surgery before the procedure. If a doctor does not inform the patient, he will be accused of failure in his work.

The woman’s lawyer argued in court that she agreed with the doctor to use anesthesia but the latter did not tell her what would happen after the surgery.

Meanwhile, the First Instance Court obliged the director general of the Public Authority for Handicappe­d Affairs (PAHA) to reopen the medical file of the daughter of a Kuwaiti and to issue a certificat­e stating that his daughter’s disability is medium with permanent difficulty in moving for her to obtain her rights according to Handicappe­d Law number 8/2010.

Case files indicate the citizen’s daughter had earlier obtained a certificat­e from PAHA, so the citizen was surprised when the authority stopped granting privileges to his daughter as it issued a decision stating she is not disabled. The citizen complained and requested that his daughter should be added to the disability roster again.
