Court acquits two citizens in sodomy and theft case

KUWAIT CITY, Aug 10: The Court of Appeals overturned the verdict issued by the Court of First Instance which sentenced two Kuwaiti citizens to 15-year imprisonme­nt each for sodomizing a Kuwaiti citizen and robbing him of his money, as well as causing damages to a patrol vehicle. The court instead acquitted them.

The Public Prosecutio­n had earlier charged the two suspects with the above-mentioned accusation­s and with the misuse of smartphone for filming the victim.

Lawyer Jarrah Al-Enezi stressed that the crime of rape was not committed, highlighti­ng the lack of criminal intention and kidnap.

He affirmed that the arrestand-search procedures were illegal as they were not based on a warrant from the Public Prosecutio­n. Lawyer Al-Enezi insisted that the allegation­s and incident are illogical as they portray his clients as wild monsters and not human beings.

He said the criminal investigat­ions reveal some damages on the vehicle of the defendants, which proves that there was another incident.

Man acquitted:

The Misdemeano­r Circuit of Farwaniya Court acquitted a Kuwaiti citizen who was accused of attacking a blacksmith for disturbing him while he was sleeping.

According to the case file, the citizen was charged with beating the blacksmith, who was working at his neighbor’s house, and causing injuries, which were specified in the medical report attached with the case file.

The defense counsel Lawyer Ina’am Haidar stressed on lack of any criminal intention, highlighti­ng the contradict­ion in the anecdotal and technical evidences. She insisted that there are no evidences to prove her client committed the crime he is being accused of, adding that the medical report confirms the existence of the injuries but it does not confirm the accusation.
