Answer: Under Kuwait Labour Law the indemnity is calculated by using the latest remuneration which includes the basic salary and the allowances given at regular intervals.

Your friend’s indemnity will be calculated as follows:

Service: 7.25 years, total salary: KD315/- (salary KD235+housing allowance KD 50+transportation KD30)

For the first 5 years of service your friend gets 15 days pay for each year=75 days. But these days have to be divided by 26 working days in a month)=2.88 months salary. For the remaining 2.25 years your friend gets one month salary for each year=2.25 months salary. Total 2.88+2.25=5.13 months salary=KD315x5.13=KD1,615.95 but as your friend has resigned with over 5 years but less than 10 years service your friend is entitled to only two-thirds of this total=KD1,077.3.
