Court orders MoF to return man’s over KD2m
KUWAIT CITY, Oct 13: The Court of Cassation presided over by Judge Fouad Al-Zuwaid obliged undersecretary of the Ministry of Finance to repay a Kuwaiti citizen two million nine hundred thousand dinars which the ministry had collected from him unlawfully, given that his building was not on an undeveloped land, reports Aljarida daily.
According to the case file, the court rejected the appeal submitted by the Ministry of Finance requesting rejection of the citizen’s claim on the basis of its eligibility to collect fees in exchange for the ministry’s services on an undeveloped land, which is in accordance with Law No. 8/2008.
However, the Court of Cassation affirmed that the state’s entitlement to these fees is linked to the availability of infrastructure and the delivery of electricity in the areas that deserve fees, and that the land owned by the citizen is not among those areas.

The Public Prosecution has referred an unidentified lawyer to the Criminal Court for human trafficking and money laundering, reports Al-Anba daily.
An informed source stated the Criminal Court will look into the case next Thursday.
The source pointed out during the investigations by the Prosecution, the accused is accused of bringing more than 300 workers to work for a restaurant and parties organizing company and allegedly made more than 50,000 dinars.
The source pointed out the arrest of the suspect came after a large number of workers complained that the suspect did not fulfill his promises primarily of which is he did not give them housing, abandoned them in Jleeb Al-Shuyoukh area and failed to give them jobs or paid their salaries.

The Court of Appeals overturned the verdict issued by the Court of First Instance which ordered to place a juvenile under judicial probation for a period of one year. The court instead acquitted him of possession of a psychotropic substance “methamphetamine” with the intention to consume, reports Al-Anba daily.
According to the case file, the Public Prosecution accused the juvenile of obtaining narcotic substance with the intention to consume and without proper authorization.
The arresting officer explained that the defendant was in a vehicle which was being driven in an unsteady manner on the road. This prompted the officer to order the motorist to pull over. After conducting a precautionary search, the officer found tablets that seemed to be narcotics. Also, the motorist appeared to be intoxicated.
Representing the defendant was Lawyer Zaid Al-Khabbaz who said his client was wrongfully arrested and searched without proper legal cause, and that the arresting officer was unable to link the seized narcotic substances to his client, let alone the fact his client wasn’t the driver and the narcotics belonged to the driver of the vehicle.
