PAM okays new ‘regulation’ for one-year government contract

Sponsor vital in worker’s cancellati­on of permit

KUWAIT CITY, Jan 24: In its endeavor to amend the demographi­cs and legalize employment conditions, the Public Authority for Manpower (PAM) has approved a new regulation of the rules for granting work permits to emergency government projects through a

temporary government work contract that does not exceed one year, pointing out that the contract is automatica­lly canceled after one year from the date of expiration of the contract.

In this context reliable sources told the Al-Seyassah daily, that the new regulation­s for granting work permits include attaching a letter from the contractin­g party defining the number of workers and the duration of the contract, in addition to registerin­g the contract with the Government­al Contracts and Projects Department as well as providing a letter of guarantee concerning the number of workers required to be recruited to implement the project.

PAM added, the government contract file is canceled automatica­lly after the lapse of one year from the date of the contract’s expiration or its extensions.

PAM has set the controls also for absenteeis­m notificati­ons, indicating that the employer must, in the event of a worker’s discontinu­ation from work without an excuse, inform the competent department after seven days have passed from the date of absence in order for the prescribed measures to be taken, provided that upon obtaining the notice form the worker shall submit it to the concerned authoritie­s in the Ministry of Interior within 15 days from the date of its receipt, otherwise it will be considered null and void.

The regulation obliges the employer who submits an ‘absent or absconding’ report on one of its employees must display a copy of the letter in a visible place at the workplace until the decision is taken on the issue.

Meanwhile, the Public Authority for Manpower (PAM) recently announced the conditions for canceling the work permits of absconding expatriate workers, reports Al-Anba daily quoting a reliable source from the authority.

Speaking to the daily, the source revealed these conditions are as follows: PAM has not suspended the file or license of the entity or sponsor of the absconding worker for any reason, the work permit to be canceled is not expired, no other cancellati­on request is registered for the worker, and the entity or sponsor should issue a decision to terminate the worker.

The source added that if these conditions are met, the authority issues a decision to cancel the work permit and the worker’s residence permit in the records of the Interior Ministry will be canceled according to the service terminatio­n form and the decision of PAM.
