Two businessme­n sue Najib, Rosmah

KUALA LUMPUR: Two businessme­n have filed a suit against former prime minister Datuk Seri Najib Razak, his wife and three others, seeking RM50 million in damages over an alleged conspiracy that caused them to suffer losses.

J.R. Deepak Jaikishan, 46, and his younger brother, J. Rajesh, 45, who were directors of Radiant Splendour Sdn Bhd, filed the suit at the High Court here through Messrs Haniff Khatri on Sept 12.

The duo named Najib, Datin Seri Rosmah Mansor, Datuk Ahmad Johari Abdul Razak, Datuk Seri Abdul Azeez Abdul Rahim and Tan Sri Shukry Mohd Salleh as defendants.

Case management was fixed for Oct 4 before judge S. Nantha Balan.

The plaintiffs (Deepak, Rajesh, Radiant Splendour) alleged that Najib had abused his position by ordering Bank Kerjasama Rakyat Bhd to file various legal action, especially against Deepak.

Deepak claimed that the actions were made to prevent him from giving oral evidence under oath for a civil case in relation to the murder of Mongolian Altantuya Shaariibuu, in which Najib, Rosmah and Johari were involved.

The plaintiffs claimed that the defendants had directly or indirectly conspired to cause them to suffer losses.

They claimed that earlier, under the direction of Shukry (then Bank Kerjasama Rakyat chairman), they had entered into an agreement on July 24, 2008.

They claimed that through the agreement, the bank agreed to provide them financing of up to RM198,888,750 and, in return, they had to give up their absolute right to 80 units of condominiu­ms. The agreement was purportedl­y made as guarantee for the financing to be paid on time.

In the statement of claim, the plaintiffs alleged that on April 19, 2013, they had made an agreement with the bank to settle the legal dispute through Najib, Rosmah and Shukry’s orders.

They claimed that on June 30, 2016, a settlement of the legal dispute was reached through a suggestion by Najib and Rosmah through Azeez at Shukry’s office.

In the meeting, the plaintiff claimed that the agreed settlement amount was RM22 million, which was to be paid by Azeez on behalf of Najib and Rosmah, who had interest in the property.

The plaintiffs also claimed that the chronology of the evidence in relation to Najib’s and Rosmah’s involvemen­t were contained in a letter dated May 8, 2017, issued by Shukry.

They said the letter had, among others, explained that the RM22 million payment to the bank was put on hold upon the defendant’s orders due to threats from Najib and Rosmah.

The plaintiffs are claiming that the bank had committed fraud and abuse of process against them. Apart from the RM50 million general damages, the plaintiffs were also seeking RM2.6 million in exemplary and prolonged damages.
