Ex-PM applies to set aside decision
PUTRAJAYA: Datuk Seri Najib Razak has filed an application to set aside the High Court’s decision allowing the prosecution to withdraw the certificate to transfer corruption charges against him in regard to SRC International Sdn Bhd dealings.
Najib’s lead counsel Tan Sri Muhammad Shafee Abdullah said the defence would also file an application at the Court of Appeal to postpone the trial of the case which was set for Feb 12.
“We have already filed the notice of appeal this afternoon, accompanied by a certificate of urgency. The withdrawal of certificate to transfer my client’s criminal breach of trust and power abuse charges will affect the entire proceedings and can be deemed illegal,” he said before a three-man panel comprising Datuk Kamardin Hashim, Datuk Mohamad Zabidin Mohd Diah and Datuk Harmindar Singh Dhaliwal.
Earlier, Attorney-General Tommy Thomas, before High Court judge Mohd Nazlan Mohd Ghazali, had withdrawn the certificate to transfer seven charges against Najib to avoid any possible argument that the transfer was null and void.
