Counterclaim by 5 ex-FGV directors struck out
KUALA LUMPUR: The High Court has allowed FGV Holdings Bhd’s application to strike out the counterclaim filed by five of its former non-executive directors against the company.
The counterclaim was over losses suffered by the company in the acquisition of Asia Plantation Ltd (APL) in 2014.
The decision was made by judge Datuk Azimah Omar in her chambers yesterday, where it was related to lawyers representing FGV Holdings and the five directors.
Azimah, in striking out the application, said the counterclaim by the five former FGV Holdings directors was baseless.
This was informed by counsel Andrew Chiew Ean Vooi who acted for FGV Holdings.
Chiew said the court had ordered cost of RM8,000 to be paid to the company. The court, he said, fixed Jan 14 for case management of the suit filed by FGV Holdings.
The five were among 14 individuals sued by FGV Holdings to claim RM514 million following losses arising from the takeover.
They are Tan Sri Ismee Ismail, Wan Abdul Aziz Wan Abdullah, Tan Sri Sulaiman Mahbob, Datuk Nozirah Bahari and Datuk Fazlur Rahman Ebrahim who were represented by counsel Fahda Nur Ahmad Kamar.
Others named in the suit included Datuk Azhar Abdul Hamid, Mohd Hassan Ahmad, Datuk Dr Othman Omar, Dr Mohamed Nazeeb P. Alithambi, Datuk Dr Salmiah Ahmad, Datin Hoi Lai Peng, Datuk Yusli Mohamed Yusoff, Dr Nesadurai Kalanithi, Datuk Mohd Anwar Yahya and Datuk Mohamed Suffian Awang.
On Nov 23 last year, FGV Holdings filed a suit to claim RM514 million, as well as compensation against its former president and chief executive officer Datuk Mohd Emir Mavani Abdullah and 13 others on the acquisition of APL in 2014.
According to the Bursa Malaysia filing, the suit was over the takeover of 100 per cent equity in APL through a conditional voluntary cash offer in 2014.
