Man jailed for trespassin­g on ex-wife’s house

KOTA KINABALU: A 22year-old father was yesterday sentenced to six months in jail by the Magistrate’s Court here for trespassin­g on his ex-wife’s house to see his child.

Zangir Mohd Afzul, who was brought before magistrate Cindy Mc Juce Balitus, admitted to trespassin­g on the house in Taman Bukit Sepanggar on March 1 this year at about 10.50am.

The indictment came under Section 448 of the Penal Code, which provides for imprisonme­nt of not more than three years or a fine of up to RM5,000 or both, upon conviction.

In mitigation, Zangir’s counsel PJ Pereira urged the court to consider the fact that the former factory worker went to his exwife’s house simply to see his one-year-old child.

However, said Pereira, Zangir did not get permission from his ex-wife nor her new husband, who lodged a police report later on.

Prosecutin­g officer Inspector Isfandiar Dr. Jasdi left it to the court’s discretion to impose an appropriat­e sentence on the accused.

According to the facts of the case, Zangir’s ex-wife saw him behind her house before he climbed over the gate and went to the front of the house.

Zangir then climbed a pole and entered the house through a balcony, and his ex-wife called her husband, who notified the police thereafter.

The court ordered for Zangir to serve his sentence from his date of arrest on March 10 this year.
