Restaurant owner claims trial to charge By Safrah Mat Salleh

KOTA KINABALU: The Sessions Court here yesterday fixed February 13 next year for the trial of a restaurant owner for failing to produce sales receipt, purchase invoice and price mark to the Domestic Trade, Cooperativ­es and Consumeris­m Ministry (KPDNKK).

Judge Indra Hj Ayub set the date for Shihan Mohd Salim, 26, after he maintained his plea of not guilty to a charge under Section 21 (5) of the Price Control and Anti-Profiteeri­ng Act 2011 and punishable under Section 57 of the same Act, when the case came up for pre-trial case management yesterday.

The indictment provides for a RM100,000 maximum fine and also up to RM250,000 fine for a second or subsequent offence if such person is a corporate figure.

If such person is not a corporate person, a maximum fine of RM50,000 or a jail term of up to two years or both, and for a second or subsequent offence, up to RM100,000 fine or a maximum jail term of five years, or both, upon conviction.

Shihan was alleged to have failed in completing the informatio­n as well as producing Iced Milo sales receipt, purchase invoice of Milo, milk and ice and price mark for Iced Milo for the month of January 2015 until March 2016.

The items failed to be completed and produced within seven working days starting from May 9.

The alleged offence was committed at Nasi Kandar Anak Mami, The Restaurant 3, Ground Floor of Manggatal Plaza, Phase II here on May 19.

Shihan, who was unrepresen­ted, is currently released on RM20,000 bail with RM2,500 deposited in one local surety, pending disposal of the case.
