Company charged for selling LPG to unlicenced firm without authorisat­ion

SHAH ALAM: A company was charged in the Sessions Court here yesterday for selling controlled items, namely 2,234 cylinders of liquefied petroleum gas (LPG) weighing 31,212 kilogramme­s to another unlicenced company.

Merasega Enterprise Sdn Bhd represente­d by two of its directors, Choy Mew Kong, 60, and Choy Teik Hooi, 36, (she) pleaded not guilty when the charges were read to them before Judge Ahmad Azhari Abdul Hamid.

Merasega Enterprise as a licensed wholesaler was alleged to have sold the controlled items, which were also scheduled items, to Wang Gas Trading, a company without a license or written permission from the Supply Officer, which violates Regulation 9(2) of the Control of Supplies Regulation­s 1974.

The company was charged with committing six offences at its premises in Taman Perindustr­ian Puchong, near here, between June 1 and 7.

Merasega Enterprise in the meantime pleaded not guilty to a charge of performing 71 purchases involving 2,936 cylinders of LPG weighing 124,120 kilogramme­s from Wang Gas Trading, which does not have a licence or written authorisat­ion to sell LPG, from Feb to April, at the same premises.

Merasega Enterprise also pleaded not guilty to another charge of failing to produce a stock book on LPG supply required by the Assistant Controller, at about 4.20pm on June 8, at its premises.

For all the charges, the company can be punished under Section 22(2) of the Control of Supplies Act 1961, which provides for a maximum fine of RM2 million and for the second and subsequent offences, a fine of up to RM5 million, if convicted.

Meanwhile, in the same proceeding­s, Mew Kong and Teik Hooi each faced eight charges in their capacity as directors of the company.

They pleaded not guilty and claimed trial.

The deputy public prosecutor from the Ministry of Domestic Trade,

Cooperativ­es and Consumeris­m Mohd Firdaus Abu Hanipah informed the court that the company and two of its directors had sent representa­tions on the case, and requested for a mention date pending the outcome of the representa­tion.

Judge Ahmad Azhari then fixed Jan 25 for mention of the case, pending the outcome of the representa­tions and submission of documents. - Bernama
