Tian Chua remains as MP – Deputy Speaker

KUALA LUMPUR: Member of Parliament for Batu, Chua Tian Chang or better known as Tian Chua, remains as an elected representa­tive until the completion of the legal process involving his conviction case.

Dewan Rakyat Deputy Speaker, Datuk Seri Ronald Kiandee said Tian Chua who was yesterday fined RM3,000 by the Petaling Jaya Sessions Court for insulting a police officer could still appeal up to the Federal Court level.

“He will not be disqualifi­ed immediatel­y (as MP) but until all the due legal process is completed if he is still found guilty. Then only he will lose his position as MP, as provided by the Federal Constituti­on,” he told Bernama at Parliament building yesterday.

Tian Chua, who is also Parti Keadilan Rakyat (PKR) vice-president, was fined RM3,000 or three months’ jail by the Sessions Court after he was found guilty of insulting a police officer three years ago.

Hakim Yasmin Abdul Razak handed down the sentence on Tian Chua after finding that the prosecutio­n had succeeded in establishi­ng the case beyond reasonable doubts.

Tian Chua was charged with uttering words at Petaling Jaya police officer DSP Glenn A. Sinappah with intention to insult his modesty.

The offence was committed at the main exit of Armada Hotel at 7.45 pm on April 14, 2014.

The charge, under Section 509 of the Penal Code, provides an imprisonme­nt for up to five years, or fine, or both, upon conviction.

Under the Federal Constituti­on, a member of Parliament found guilty of an offence and sentenced to over one year’s jail or fined RM2,000 will lose his position as MP.
