Gardener gets 15 years for sex with underage students

TAWAU: A 50-year-old gardener's appetite for sex with young girls has earned him 15 years in jail and four of the cane.

The Sessions Court here yesterday passed the sentence on Chao bin Cae who was charged with two counts of statutory rape on two 15-year-old Form Three schoolgirls.

Sessions Court judge Egusra Ali meted on the sentence on Chao who was charged under Section 376(1)(d) and Section 376 (2) of the Penal Code which carries imprisonment of not less than 10 years and not more than 30 years and whippings.

On the first charge, the accused who is an illegal immigrant, was sentenced to ten years in jail and two strokes of the cane, and for the second charge, he was sentenced to five years in jail and two strokes of the cane.

The accused committed the offence on August 16, 2016 at about 2pm in a room of a lodging house.

The court was told that the accused had sex with the victim and paid her RM100.

On the second count, the accused committed the same act on the second victim on the same day about 3pm. He paid the victim RM200.

The facts of the case stated that the two students frequently left their homes and needed money to enjoy. Both girls were introduced to the accused by a friend.

A police report was lodged that led to the arrest of the accused on September 9, 2016 at about 1.45pm at the lodging house.

The accused, who claimed he did not know that the two girls were underage, was charged with statutory rape.

He was ordered to serve the sentences simultaneously.
