Man jailed over stolen motorcycle

KOTA KINABALU: A man was sentenced to 18 months' jail by the Magistrate's Court here yesterday for retaining a stolen motorcycle.

Mohd Azrulnizam Daut, 35, pleaded guilty before Magistrate Cindy Mc Juce Balitus to the offence under Section 411 of the Penal Code.

The indictment carries a jail term of up to five years or with a fine or both.

He committed the offence allegedly together with an accomplice, Michelle Mercy Charles, 25, near Harbour City here at about 2am on March 18.

Michelle, however, claimed trial to the charge and the magistrate fixed April 25 for mention of the case of Michelle to get instructio­ns from the deputy public prosecutor.

In mitigation, Mohd Azrulnizam told the court that he was not aware that the motorcycle was stolen property because he borrowed it from a friend.

He also said Michelle was not involved in the matter.

In a separate case, the same court set April 25 for case management of a father of two, who was charged with retaining a stolen laptop.

The magistrate set the date after Sunardi Matli claimed trial to the offence framed under Section 411 of the Penal Code.

He was alleged to have retained the stolen laptop belonging to one Vincent Yap in a house at Kampung Sekambu, Petagas at 7.30pm on March 10.

Sunardi was granted bail and released on RM3,500 bail with two local sureties pending disposal of the case.
