Man jailed for intimidation, mischief
KOTA KINABALU: A man was jailed for 13 months by the Magistrate’s Court here for threatening a man and committing mischief.
Magistrate Jessica Ombou Kakayun imposed the sentence on Arzibar Umdan, 29, after he pleaded guilty to both his charges yesterday.
On the first count, the unrepresented accused was sentenced to three months’ jail for threatening a 38-year-old man at the water area of a resort here on June 26.
The offence was under Section 506 of the Penal Code which is punishable by a maximum jail term of seven years or a fine or both, upon conviction.
Arzibar was also sentenced to 10 months behind bars for damaging the fishing boat of a 42-year-old man at the time and place.
He was convicted under Section 426 of the same Code which carries a jail term of up to five years or a fine or both, upon conviction.
The prosecution told the court that a police team had arrived at the said place after receiving information that there was a man (later known as the accused), who went amok.
The accused, who was holding an axe and a machete, acted aggressively while he was being calmed down by the police personnel.
One of the policemen fired a shot to the air as a warning sign. When they tried to arrest the accused, a scuffle broke out.
The court ordered the accused to serve his jail term consecutively.
