Timorese jailed 15 years for causing death of Indonesian
LAHAD DATU: The Sessions Court here sentenced a Timorese to 15 years' imprisonment yesterday for causing the death of an Indonesian man.
Jhony Hafid, 28, was jailed after he pleaded guilty before judge Zaini Fishir @Fisal to a charge under Section 304(a) of the Penal Code.
The deputy public prosecutor told the court that the accused was arrested on October 30, last year after causing the death of Asriansa Mohd Said, 28.
Prior to the incident, the accused who was drunk after a ceremony was taken home by his friend using his motorcycle.
His friend later took the motorcycle to send home other friends who were also drunk at the ceremony.
After waiting for some time for his friend and his motorcycle, the accused waited at the roadside near his house with a machete.
While waiting, the accused saw the victim and his friend passing by while riding the motorcycle and shouted ‘Oii' as he thought that the victim and his friend came from the ceremony.
The victim who was also drunk felt dissatisfied at being shouted at by the accused and ordered his friend to turn the motorcycle around towards the accused. The victim later approached the accused and hit the accused using his helmet repeatedly.
The accused did not know why the victim hit him but later saw the victim's friend taking off his belt with an iron buckle and approach them.
Fearing that he would be seriously beaten by the victim and his friend, he took out the machete and flipped it towards the victim which hit the victim's neck.
The accused then fled the scene, leaving behind the victim who was seriously injured and later died due to the injuries.
The judge ordered the accused to serve his imprisonment from the date he was arrested.
