Five Indonesian­s jailed, fined under Societies Act

TAWAU: A 52-year-old Indonesian man was jailed for 24 months and fined RM8,000 in default 12 months in jail by the Session Court here yesterday for committing an offence under the Societies Act, while four other Indonesian­s including two women, were jailed for 18 months and fined RM5,000 in default six months in prison by a Magistrate’s Court here for committing an offence under the Societies Act.

Sessions Court Judge Awang Kerisnada Awang Mahmud handed down the sentence to Aco bin Lolong who pleaded guilty to a charge under Section 42 of the Societies Act 1966 which carries five years in jail or a fine not more than RM15,000 or both upon conviction.

The accused was charged with helping Pertubuhan Pemuda Panca Marga at an unnumbered house at Kampung Tass Andrassy, Mile 13 Rangau on January 20, this year at about 4pm.

The accused used the Pertubuhan Pemuda Panca Marga to cheat eight men and seven women who are his countrymen into believing that being a member of the society that they can use the membership card as an identity card and are immune to Malaysian laws.

A police team acting on public informatio­n that several people camouflage­d themselves with military uniform gathered at a house in Tass, raided the house and found Indonesian­s - eight men and seven women.

At the Magistrate’s Court, Aco was sentenced to a total of 54 months in jail for cheating and dishonestl­y inducing payment from four of his countrymen.

Magistrate Ferhansah Farene made the decision after Aco pleaded guilty to four charges under Section 420 of the Penal Code which provides between one year to 10 years in prison, whipping and fines upon conviction.

He committed the offence last year by offering membership card of Pemuda Panca Marga (PPM) and claiming that it could be used as an identity card in Malaysia and guaranteed immunity from Malaysian laws to the card holder.

The accused cheated Mansur bin Pate, 35, of RM600, Ahmad Faisal bin Jamaluddin, 40, of RM325, Bahrun bin Makawali, 50, of RM800 and RM950.

The court ordered the sentences to run from the date of arrest and the accused be referred to the Immigratio­n Department after serving his sentences.

Meanwhile, the four other Indonesian­s, including the two women, were sentenced to 18 months’ jail and RM5,000 fine in default six months’ jail for becoming members of Pertubuhan Pemuda Panca Marga, which was an offence under the law.

Magistrate Muhammad Faizal imposed the sentence on P.T Ranggong bin P.T Mappincara, 60, Sanawiah binti Aco, 29, Ida binti Abu, 45, and Ahmad Faisal bin Jamaluddin, 40, for an offence under Section 43 of the Societies Act 1966 which provides for imprisonme­nt of not more than three years and a fine not more than RM5,000 or both upon conviction.
