Speaker, secretary succeed in striking out suit by MP
KUALA LUMPUR: Dewan Rakyat speaker and secretary yesterday succeeded in their application to strike out a suit filed by Petaling Jaya Selatan member of Parliament Hee Loy Sian over the rejection of his two questions on 1Malaysia Development Berhad (1MDB) in Parliament.
High Court judge Datuk Wira Kamaludin Md Said allowed the application by Dewan Rakyat secretary Datuk Roosme Hamzah and Speaker Tan Sri Pandikar Amin Mulia as defendants in his chambers.
Present at the proceeding were senior federal counsel Shamsul Bolhassan, representing the two defendants and lawyer N. Surendran, representing Hee as the plaintiff.
Surendran when met by reporters after the proceeding said no reason was given by the court when allowing the application by the defendants to strike out the suit and his client would file an appeal on yesterday's decision as soon as possible.
Pandikar Amin and Roosme filed an application to strike out the suit by Hee on Sept 13, 2017 on the grounds that the originating summons did not show any reasonable cause of action against them and was an abuse of court process.
Hee, 48, who also present at yesterday's proceeding filed the suit on Aug 2, 2017.
In unrelated case, the court postponed to Thursday its decision on an application by Pandikar Amin and Roosme to strike out the originating summons filed against them by former Sungai Benut MP Mohamed Tawfik Tun Dr Ismail in a case pertaining to the Syariah Courts (Criminal Jurisdiction) (Amendment) 2016 bill or RUU 355.
Lawyer Rosli Dahlan, representing Mohamed Tawfik said the court postponed its decision on Mohamed Tawfik's application as Kamaludin needed more time to consider the legal issues before delivering his decision.
