Rape: Prosecution’s appeal against sentence deferred
KOTA KINABALU: The High Court here adjourned to March 2 the prosecution’s appeal against a plumber’s sentence for raping his cousin to allow him to engage a lawyer to represent him.
Justice Datuk Nurchaya Hj Arshad put off the case of the 30-year-old respondent, who requested time to appoint a lawyer to defend him when the appeal came up for hearing LAHAD DATU: Two local individuals pleaded not guilty at the Magistrate’s Court here yesterday to charges of carrying out a business that could affect the interests of a cooperative or its member.
Saleh Bin Alibasa, 61, and Johani Bin Abd Halim, 58, were charged under Section 69 (1)(a)(i) of Co-operative Act 1993 before Sessions Court Judge Zaini Fishir@Fisal. yesterday.
The respondent was sentenced to 15 years’ jail plus one stroke of the cane by the Sessions Court here for raping his 18year-old cousin on November 17, 2017.
The lower court also ordered the respondent to compensate the victim’s family with RM10,000, in default, six months’ jail.

They are accused of signing five cheques for a total of RM123,800 belonging to Telisai Cooperative Land Development Society Limited on November 27, 2002 without obtaining approval from the cooperative members. Their action later allegedly caused harm to the cooperative.
Salleh Bin Alibada was detained on February 22, while Johani was detained on ordered the respondent to be placed under police supervision for two years after serving his jail term.
The respondent had pleaded guilty to raping the victim at an unnumbered house in Beaufort, at end October, 2016.
The offence, under Section 376 (1) of the Penal Code, carries a jail term of up to 20 years and whipping, upon conviction.
Ex-cooperative chairman, secretary charged over RM123,800 cheques
February 23.
The accused, who were former chairman and former secretary of Telisai Cooperative Land Development Society Limited, face a fine of up to RM1 million or up to one year’s imprisonment or to both.
The judge allowed RM20,000 bail for each of them with two sureties and set March 15 for mention of the case.
