Businessma­n denies threatenin­g neighbour with homemade shotgun

KOTA KINABALU: A businessma­n claimed trial in the Magistrate’s Court here yesterday to two charges of threatenin­g his neighbour by pointing a homemade shotgun at the latter’s tummy and illegally possessing the said firearm.

On the first charge, Sebastian Tamin, 40, who appeared before Magistrate Cindy Mc Juce Balitus, was accused of pointing the shotgun at the 22-year-old man’s tummy at a house at Kampung Sugud Timpangoh in Penampang at 3.30pm on May 3, 2017.

The charge under Section 506 of the Penal Code carries a jail term of up to two years or a fine or both, upon conviction.

The second charge accused Sabastian of possessing the weapon and a Buck Shot type bullet without a licence at the same time and place.

The accused was charged under Section 8 (a) of the Firearms Act 1960 which is punishable by a maximum jail of seven years or a fine or both upon conviction.

The court fixed May 17 for the case management and released the accused on bail of RM2,500 each of the charges with two local sureties.

The magistrate also ordered the accused to report once in two weeks to the investigat­ing officer pending the disposal of the case.

Prosecutin­g officer Inspector Lim Swee Beng prosecuted while the accused was represente­d by counsel Nurul Rafeeqa Afdul Mutolip.
