Verdict Aug 24 in Labuan woman's murder case
KOTA KINABALU: A construction labourer will know his fate at the High Court in Labuan on August 24 for allegedly murdering a woman two years ago.
Justice Ravinthran Paramaguru fixed the date to deliver his decision on Adzman Boy, 24, after hearing additional submission from the prosecution yesterday.
Deputy public prosecutor Nartiah F. Mirchelle Sambatan argued on issues raised by the accused on whether the deceased was hit by a metal rod, and injuries sustained by the deceased.
Nartiah argued that the accused in his defence testified that he did not hit the deceased with the said rod, so which evidence should the court believe.
The prosecution submitted that the evidence by the sixth prosecution witness (PW6) was more credible than the accused's testimony as PW6's evidence was corroborated by the other prosecution witnesses.
Nartiah further submitted that the evidence by eighth prosecution witness (PW8), who was the pathologist, testified that the metal rod allegedly used in this case would cause the injuries sustained by the deceased.
She submitted that the accused had failed to cast any reasonable doubt on the prosecution's case and urged court to convict the accused for the offence as charged under Section 302 of the Penal Code.
The indictment carries the mandatory death sentence, upon conviction.
The accused, represented by counsel Ram Singh, was alleged to have murdered the 26-year-old deceased at the road heading to Kampung Sungai Lada in Labuan between 10.30pm and 11.20pm on August 15, 2016.
The court had on May 25 ruled that the prosecution had established a prima facie case against the accused and the accused had opted to give his defence under oath.
The decision will be delivered at the High Court in Labuan.
