KUALA LUMPUR: Activist Adam Adli Abd Halim remains a free man and discharged of all charges for allegedly participating in the #KitaLawan assembly three years ago after the prosecution today withdrew its appeal against a decision by a Magistrate’s Court in acquitting and discharging him of the charges.

High Court judge Mohd Nazlan Mohd Ghazali dismissed the appeal after the prosecution, conducted by deputy public prosecutor Raja Zaizul Faridah Raja Zaharudin, informed the court that they would not proceed with the appeal that was filed last Dec 4.

Lawyer Eric Paulsen, who represented Adam Adli, did not object.

On Nov 28 last year, Magistrate Ahmad Solihin Abd Wahid acquitted and discharged Adam Adli of all charges of participating in rally without calling for his defence after finding that the prosecution had failed to establish a prima facie case against him at the end of the prosecution’s case.

According to the charge, Adam Adli, 28 and Orange 13 chairman, Mohd Fariz Abd Talib @ Musa, 47, were charged together for joining the street protest which began in front if Sogo shopping complex in Jalan Tuanku Abdul Rahman and ended in the Esplanade in KLCC between 4pm and 7.30 pm on Feb 28, 2015.

They were charged under Section 4 (2) (c) of the Peaceful Assembly Act 2012, which carries a fine not exceeding RM10,000 upon conviction.
